DIVORCE 101 with DIVAS 3360 Long Prairie Road, Flower Mound, Texas

In standard family court litigation, fit parents are routinely told that trial judges have unbounded discretion to divide custody and assign possession schedules. However, controlling Supreme Court jurisprudence strictly establishes that natural parental rights cannot be denied, stripped, or nullified without proving unfitness under strict scrutiny. Understanding these core constitutional protections empowers parents to hold attorneys and trial judges accountable to the law.

Executive Summary & Key Takeaways

Understanding Parental Rights in Divorce

One of the key topics covered at Divorce 101 with Divas is parental rights. Ron B. Palmer shares insights into how divorce courts often treat divorced parents differently from married parents. He highlights a Tennessee Supreme Court case, Hawk vs. Hawk, which states that parental rights are strongly protected but only fully apply to intact families.

Key Takeaways from Hawk vs. Hawk

  • Bias in Courts: Discover the bias and prejudice that divorced parents often face in court.
  • Harm to Children: Understand how courts may view divorce as inherently harmful to children, leading to state intervention in custody issues.
  • Parental Rights: Learn that parental rights are individual and not tied to the marriage, meaning there is no justification for treating fit divorced parents differently from fit married parents.

The Importance of Making Different Choices

To achieve different results in your life, you need to start by making different choices. Divorce 101 with Divas provides you with the information and resources you need to make informed decisions and take control of your future.

  • Seek Support: Connect with a supportive community that understands what you're going through.
  • Avoid Reinventing the Wheel: Learn from others who have been through divorce and can share valuable insights and strategies.

Sneak Peek: Parental Rights and Divorce

Parental rights are not tied to the marriage. This means there is no justification for treating fit divorced parents differently from fit married parents. The state should be prohibited from discriminating against fit parents regardless of their marital status or changes in their marital status.

Key Points to Remember

  • Individual Rights: Parental rights are individual in nature and have no relationship to the marriage.
  • Equal Treatment: Divorced parents should not be classified separately from married parents.
  • No License to Deprive: Divorce is not a license for the other parent or the state to deprive you of the ability to change your life and your children's lives.

consuming mistakes at divorce 101 with divas you'll meet great people and have a supportive group with all the services that you don't have to go out and find yourself plus you'll get valuable information from Top exps in their field there's no other organization like this so join us Saturday and find out some answers to some of the questions like have you ever wondered why you get treated different in divorce let's take a look at a short clip from the class that Ron and I teach and let's hear what he has to say about why you get treated different in divorce one of the places that we really see this bias and prejudice against divorced parents

really stand out is in a case called Hulk versus hulke out of Tennessee and this is a Tennessee Supreme Court case so hulke went very far to state that parents have rights to their children these rights are strongly strongly protected but then it took an extra step and it said these rights only apply to intact families or in other words the classic nuclear family with parent two parents and children and they said not only do these rights only apply to intact families that when intact families go through divorce there is harm to the children from the divorce and that harm alone is enough to Warrant the state stepping in and determining custody for these

children right and we te this apart in a number of ways right but it's very instructive to read Hulk and to really see the kind of prejudice and bias and bigotry we're facing even the highest levels of some of these courts they still have this deep seated prejudice against divorce and divorcing parents divorce affects the marriage divorce is about separating two married parents and making them single parents but your parental rights have no relationship whatsoever to the marriage so if that's the case how do divorce courts who are overseeing a separation of marriage parents and the single parents how do they justify intervention into custody issues here's another sneak peek of information that you'll get

parental rights are not tied to the marriage this means that there's no justification for treating fit divorced parents differently from fit married parents so what they're doing to treat us differently is to say well there is a real distinction between married and single and therefore when you go from married to single that justifies intervention by the state but keep in mind parental rights are individual in nature they have no relationship whatsoever to the marriage so you by the rules that the Supreme Court has put down you cannot classify divorced parents separately from Married parents so what we have is the class of all fit parents and the states are pro should be and ultimately

we hope will be prohibited from discriminating against fit parents regardless of their marital status and regardless of changes in their marital status divorce is not a license for the other parent or the state to deprive you of the ability to change your life and your children's lives that information is from a class that we teach if you want more information about the class you can email us at instructors ofix family courts.com we look forward to helping you find your way out of the Trap of being glued to the decisions that you made during your marriage come and see us Saturday so you can learn how to stay out of those traps and never
