Overview: Were You Told NOT to Use Your Rights
Are you debating whether to use your rights arguments or whether you should prove child psychological abuse and parental alienation?
Sherry Palmer compares the two options and how much each one costs.
In standard family court litigation, fit parents are routinely told that trial judges have unbounded discretion to divide custody and assign possession schedules. However, controlling Supreme Court jurisprudence strictly establishes that natural parental rights cannot be denied, stripped, or nullified without proving unfitness under strict scrutiny. Understanding these core constitutional protections empowers parents to hold attorneys and trial judges accountable to the law.
Executive Summary & Key Takeaways
- ✓ Exposes the procedural and constitutional defects in standard family court custody proceedings.
- ✓ Explains why fundamental parental rights are protected under the Fourteenth Amendment Due Process Clause.
- ✓ Equips parents with actionable legal arguments to counter judicial overreach and preserve the record for appeal.

oh hi good evening everybody tonight we're gonna talk about whether or not you're being told not to do use your right so the reason I put this topic is because I am always amazed at how many people come to us and say we're being told don't use our rights and I'm not just talking about the courts telling them this I'm talking about other parents other organizations just other groups or individuals who are telling them don't do this try that and they try to drag oh right so you might wonder how do some of these cases get where they are in the first place right how does a case go from let's say
several years of everything's working out okay you're getting along and then all of a sudden you're completely cut off and then what happens you're in panic mode and I know my voice sounds funny nothing I can do about it it's wins and everything else so bear with me here so you're in panic mode you are at your most vulnerable when you are being cut off from your children right incidents or an incident that might have happened that led up to this and now you're trying to find a solution to work back out of that and get your time and your rights back to your child so there's a foreign exemplar who maybe make a mistake and expose
their child to something that they believed in I'll give you an idea for an example religion you might have decided to test out a new religion the other parent gets pissed off next thing you know the judge is siding with them and you are cut off so what do you do your stress being out here on Facebook right understandably so so you start to do things that get used against you you take advice of people and they say contact the school find out how they're doing these are the common things okay and they try to get you to collect evidence so you can try and use that against the other parent to correct
the situation that's now been artificially created because of one incident so you try to show the other parent isn't perfect so you can get back in favor of the court right how many of you done that you might even be approached by people who say get reunification therapy right and how expensive is that so I'm going to show you how using your rights is less expensive and should not actually be in comparison to some of these other things that people are introducing to you all right like reunification therapy or somebody saying bring in a psychologist getcount counseling for you and then how do you look at these things is is it either/or
to you so this either/or to you a type of comment and let me know if you can hear me I'm using my computer so I really don't know if any of you any of you are hearing me I don't even know if I'll see the comments let me look here but if you're there and you can hear me please type that yes you can hear me I think I can write a comment here you're alright comment can you hear me okay so I wrote a comment so hopefully you'll write one back okay we're gonna keep going and hope that you can hear so the most common one that I hear is get asked for
a guard guardian ad litem or a gal ask for an amicus right okay thanks for commenting budge thanks Julie for letting me know so how many of you were tricked into thinking asking for a gal was going to protect your rights so say yes or no I'm there so you ask the court to appoint people to protect your child and you and to restore those rights back right so they ask for psych evals custody vowels and let me give you an example what a state can appoint let's take Maryland right what can they appoint under second let me see what section it is here under Section Maryland code family law section 1 - 202 they can appoint a child
privilege attorney a best interest attorney a child advocate you know the difference between those child privilege attorney is one who decides whether a child's confidential or privileged information should be released in court okay a best interest attorney is an advocate for the child's best interests a child advocate is someone who advocates for the child's wishes did you hear anything about rights in there other than confidential or privileged information whether it should be released nothing in there that's defining that they're gonna protect you or your child's right so read the code before you ask for anything so how much does it cost when you ask for those you are gonna pay thousands of dollars that
same code has no cap on how much it costs all it says is that the fees are going to be assigned to the parents that's it it doesn't say that they're limited it doesn't say they're they can only charge a certain amount per hour so you better count on an unexpected amount I know people have paid a hundred thousand dollars in six months and guess what if you think you are going to not pay that bill like some of you can't pay all of your bill to your attorney they're gonna start sanctioning you they're gonna start striking things from your case like maybe not let your pleadings move forward maybe they'll find you or your attorney so they're
gonna start punishing you along the way and they're gonna disadvantage you throughout this case so if you cannot handle an unlimited completely uncontrollable bill then you better learn to fight against having that person appointed what do you use to fight that only thing you can use are you right you didn't have any rights you can invite it right so we just produce a brand new gal motion by the way and I'm not here to sell you guys n anything we try to create tools just to help you but we do have a new gal motion we're on informed me he posted it yesterday on her fix family courts site under our products that's
fixed family courts calm you can message me you want that stuff because I don't want you guys thinking that you know every time you come here you got to spend something you don't I want you to be able to get information we try to give you as much free as possible and a lot of you are hurting we get that we just create those to make it easier for you okay so don't ask for that unless you want to waive some of your rights to discuss for your child because you're essentially asking that court to put somebody in place to make those decisions in fact I listened to a case last night and the
attorneys did exactly that they told the judge sorry judge the parents can't settle they can't dis the mess is your mess is yours we're sorry to drop this in your lap what is that is that what you pay them for I hope not I hope you guys are getting this message in sharing it with others so that they don't fall into this trap do not let them get taken down the rabbit hole okay so let's look at how much the average child attorney cost it's anywhere from twelve hundred forty five hundred dollars to start okay you're giving them basically a retainer plus your attorney plus if you're in a divorce of an original divorce you might
end up having to pay for the other attorney or part of it as well see however the cost of a basic car basic Hyundai that maybe cost $20,000 you might as well forget about it you're gonna blow past that you think student loans are a lot take a look at some of these bills when when they're talking about court bills don't just look at how much an attorney coughs look at all the other external people that are involved in this okay so let's say you get convinced that you need to do the psych evals and that you need to get a psychologist involved what does the APA say about psychologists they say custody
issues are hard to quantify and stay with me because I'm gonna get to to your rights and how much they cost and compare this but I want you to know what these processes actually are so you understand what you're asking for and why this has gotten so ugly and so hard on you the APA says custody issues are hard to quantify and test results suggests high pop hypotheses season not definitive answers so in these situations is right from their website in these situations psychologists should use testing to create a hypothesis and then attempt to corroborate their theories with other evidence by interviewing there comes more expense third parties I'm reviewing medical mental health records and in the end
psychologists must ensure that psychological tests don't get over interpreted so how do you do that well now you've got to hire other experts if you don't like the results of the psychologists evaluation you got to pay your attorney to review everything the psychologist reviewed don't you so start at adding on the hours you got to pay another expert to come in and testify if you're gonna check if you need to challenge that report how much hi the cheapest I've seen generally if if they don't do it for free which most of them don't it's 500 but that's it that's an amazingly low amount 1,500 it's kind of average for a low level expert like
councilor and you know somebody that's you know maybe on a scale kind of pricing but you get into the experts like Colonel alienation experts like dr. Richard Rorschach you might be looking at $10,000 so anywhere from five hundred ten thousand dollars right then you might pay all this money which by the way causes you to have to need more days in court add on some more money this is all the path for not using your rights okay add in some more money you might have difficult a chair to be authorized to testify right they're gonna use da verts tests and other things so they might even they might not even get approved the judge
could reject them you don't get your money back if they get rejected they show up you paid your money so if they do get on the stand then you got to spend more days and more time to pay your attorney more to get all that testimony on the record so it takes longer to coordinate when you don't use your rights you pay more for more evidence you you pay more for more days in court you have to dig up more dirt you might have to even hire private investigators it just keeps on going so how much your rights protect you and how much do they cost nothing extra nothing use the same attorney
the same court time now if you want to add some extra things because none of them have been doing it so they don't know what the hell they're doing when it comes to these rights so you might have to invest in yourself a little to learn these rights right how much does it cost to get into our membership site so for some of you it's been $19.99 if you didn't join early it's $24.99 now you can binge on all of our materials you don't have to spend enough you can learn it in one month okay so there's a cost maybe your time right but overall if this was done correctly it would be zero
zero extra cost and in fact it would lower your cost because you wouldn't need these psychologists you wouldn't need these counselors you wouldn't need the guardian ad litems in the amicus you would just go in there and say please protect my rights and my child's rights and the court if they actually followed their Article six duty that's what they would do right so what let's look at what do you have without your rights when you're looking at whether you should use them what do you have without them any of you know would you have without your rights what would the world look like without rights excuse me for mantling can a drink
so that questions actually been asked okay you can google it and there's Bill of Rights there's Bill of Rights foundation there's other sites you can go to and it'll talk about civil rights movements and what it looks like if people who fought for our civil rights hadn't done it in fact there's a cute little cartoon on on the Bill of Rights website millet Rights Center and you can actually click to delete like your freedom of speech or your freedom of religion and it will actually change a little cartoon and delete that right and show you what the world would look like really cool I mean it's not really cool you didn't have the right but it's a
really cool little depiction cartoon so for women what would the world look like if they hadn't had rights woman that's documented to fight for women's rights and I'll fly through this quickly so don't leave me here was Elizabeth Cady Stanton in 1848 and the Quaker Letitia Lucretia Mott and so women were granted the right to vote by Congress through the 19th amendment right most of you know that that's June 4th 1919 and that was ratified on August 8th 1920 so that movement to get those rights took about twenty eight years shy of a hundred years the rights that you're fighting for are already established women's rights weren't established so your fights a little
different than theirs that yours is are you choosing not to use the rights that others have fought for you're choosing not to use those rights are you choosing to spend more money you should ask yourself if you don't use and if you really want to know what it would look like if you didn't have rights if you're not using your right look at family law don't they restrict your speech to your child wait if you get a guardian ad litem don't they expect you to do what they tell you to do in fact sometimes and then light them in the middle of you and the other parent to make the decisions like what therapist your child
goes to or counselor or whether or not they need counseling or they go to counseling whether or not they get psych evals whether or not you need psych eval so that's what it looks like to not have rights it looks like what you're going through right now and so what was the bill of rights passed for of Human Rights right you don't know what it says you can go to that site I told you Bill of Rights Institute George Mason was one of the leaders in creating the that the Bill of Rights itself in fact he stormed out of one of the constitutional meetings when he was told originally that it wasn't gonna be part
of the Constitution he knew how important it was so let me read you a quote from civil disobedience because so many of you are getting threatened right you're saying the court says if I insists or if I even bring my rights up then they're gonna punish me they're gonna make me pay the attorney's fees they're gonna say it's frivolous right so what is it that you're actually doing you need to understand this so you can stay from henry david thoreau civil disobedience if you haven't read that book you need to read it if you're involved in family law it's another thing you need to know so he says unjust laws exists shall we be content to obey
them or shall we endeavor to amend them and obey them until we have succeeded or shall we transgress them at once so some of you make different choices right I hear some of you say I don't pay child support because it goes against my beliefs I believe that I have a right to care for my children directly and you are correct that is a right and then the court makes an order that you call a void order you say I didn't agree to it right we've got a dad in jail here in Texas right now Josh I just finished a habeas with another father that just got filed excuse me that just got filed
yesterday actually finally that was a long process he said some of those exact things that went against his belief to have to pay for his children when he was there available to take care of them directly so he's challenging that order you know that wasn't the reason he gave that he wasn't paying the reason he gave us he couldn't pay that's a different topic so let me keep going with the quote men generally under such a government as this think that they ought to wait until they have persuaded the majority to alter them right that's what people do when they go try to get a new law passed like in legislation maybe
they say I'm gonna follow the way the Family Court does this until a new law gets input gets put in place like 50/50 what we're doing is helping all of you fight now because you don't have to wait for a new law you should not wait for a new law you shouldn't stop fighting to get the right laws put in place but you should not be waiting to get a new law and let me keep reading his quote so you know why they think that if they should resist the remedy would be worse than the evil but it is the fault of the government itself that the remedy is worse than the evil it makes it worse
why is it not more apt to anticipate and provide for reform why does it not cherish its Reisman minority why does it cry and resist before it is hurt why does it not encourage its citizens to be on the alert to point out its faults and do better than it would have them that was Henry David Thoreau civil disobedience I apologize if I interrupted in the quote but I wanted to give you examples you can go to Bill of Rights Institute org and I think I got that hope from there yeah and look that up and read it yourself so how do you like being told by a stranger that you cannot explain something to your child
or that you can only parent them in the manner that a gals or your ex approves of that's what you're gonna get if you don't use your rights if you don't like it then it will seem like this would be your only choice you didn't have right you couldn't even tell the judge no you didn't have rights there wouldn't even be a reason to go through the process of hiring an attorney might as well just stand there and take it you might as well just let him tell you what they're gonna take what you're gonna pay why even cost yourself more money if you didn't have rights so when you're facing the court that is actually your
opportunity to do your part to stand up against injustice so that you can get unjust laws overturned you can look these unjust laws right there in writing and orally in your testimony and have your attorney assert that this is rooks got Rights passed for blacks to not have to move towards the back of the bus this is how Jim Crow laws were overturned this is how slavery laws were overturned it's not really that tough we so recognize the difference you guys are just getting scared it's not that it's really that hard it's not that hard to understand you're right of a PhD in this to understand that you don't even have to be a lawyer
to know that you have a right to tell the court that they do not have the jurisdiction to plant that other person in place of you to determine best interest without properly justifying it right now the the details for properly justifying it might be a little more different for you to know just offhand but it's real easy to look it up got it in our membership site it's real easy to figure out if you can't figure it out send me an email simple I'm so it is your opportunity to challenge the bad practices in front of that Judge doesn't mean you're not going to get punished that's the way it is look at all the
history okay you might get punished you're just getting scared so do your part stand up against injustice and if you don't you're actually not exercising the most precious right you have which is actually civil disobedience I'm getting hoarse here civil disobedience is the number one way and the only peaceful way to exercise your objections to government running roughshod over you and your children none of the people who stood up in the civil rights movements by the way had any more power than any one of you do today to begin with did they in fact some of them had less some of them were slaves and some were women before women had rights weren't they some were
minorities Cesar Chavez so really what was the question at the beginning of this so I hope that helps all of you and you're considering dumping your rights arguments in the trashcan ignoring your rights or just plain convincing yourself that your rights do nothing for you or process that's an option your rights are the only thing that really empowers you without them you cannot tell the judge no you don't get a choice you don't get to map out your own life that's the way the family courts handle it right now isn't it looks like they got this way because of people saying they didn't have rights so let's see if you guys have questions but I'm just fun
to make sure you all understood how that works so I see some people saying it's all scam its judicial power being used against you because they're tricking people out of their rights are scaring them out of their rights let's see if you guys do you guys have any questions about whether you should use your rights or not or was that good enough and you guys get it cuz I actually just jumped on here to talk to all of you before I go jump on live with my members I'm gonna work with our members a little bit as you know they're doing the work they need to do so I don't see any good
questions here so I'm gonna jump off thanks for joining me everyone I appreciate it you all have a good night bye
