These two young parents, Kailyn Lowry and Javi Marroquin have settled on equal parenting, 50/50, and no child support. You might think,"Aha, I bet the attorneys are pissed, no more gravy train." Or you might be thinking, "The state is never going to see a penny of theirmoney now."
Unfortunately, this is not the case. The attorneys and the state will most likely have a second jab at their pocketbooks.
The most common reason for parents to end up in modification is the other parent gets involved in a new relationship. Both of theseyoung parents are in relationships so it is most likely just a matter of time before they end up right back in court. In fact, Iwouldn't be surprised if they end up back in court before a year is up.
As long as the courts continue to entertain a disagreement as grounds to deprive a parent and child of their rights, post divorcemodifications and enforcements will continue to fill the court dockets.
Equal Parenting for all parents is what the standard should be. Equal parenting should not be seen as a settlement! When one parentbelieves that they can get more than equal time if they bully you and take you to court they are much less likely to come to anagreement. Mediation fails most of the time because a parent knows they can strip the other of their equal legal rights and equalparenting time by using the state statutes and the power of the judge.
The family court system is set up to entice disagreeing parents into court. The winner could come away with quite a bounty, control overthe child, more money in their pocket, control over the other parent, and even an extra bonus when the other parent gets attacked byTitle IV-D courts and gets thrown in jail.
Most attorneys know that as long as the laws remain the same and provide enticements and promises of unconstitutional relieve even equalparenting agreements made between parents usually end up back in court for modification because those enticements are there and theyconveniently leave the door open for an unhappy parent to modify the orders any time they please because their pocketbooks benefit, theprevailing party's pocketbook benefits, and the state's coffers benefit. Ask any attorney and they will happily tell you that prettymuch anything can be used as a changed circumstance. Hell you can create a changed circumstance to get back in: change your job, get araise, get a drop in pay, child is expressing more angst in math class, the other parent has a new relationship. You name it, you cantry and use it.
Equal parenting won't really be equal parenting until the courts start protecting equal parenting.

Teen Mom Season 2 is about to be released but three of the MTV reality show stars, Chelsea Houska, Kailyn Lowry, and Leah Messer, arethreatening to quit because of Jenelle Evans and Briana de Jesus.
Season 9 of Teen Mom 2 premiered on Monday, May 7. The trailer shows that there promises to be tons of relationship drama that isescalated into family court drama. Someone calls CPS out on Jenelle to do a security check on her children. She suspects her ex. One ofthe fathers, Adam, gets supervised visitation. Javi apologized to Kail after he and Bri broke-up. Kail and Bri were having issuesbecause Bri started dating Javi. Apparently Kail felt that Briana broke "girl code" for dating her ex.
It turns out that Kail and Javi did not end back up in court after their relationships with others. Javi decided that it was not good tobe in high conflict with the mother of his children. He tweeted that he values "a good relationship with my sons mother will makeLincoln the happiest. I lost sight of that. This trip made me realize that and I've apologized to kail for my actions." For being soyoung, Javi has the right idea and has his priorities straight when it comes to parenthood.
